It states: "Those who have updated the gender marker on their birth certificate are ‘recognised’ and must be treated according to identity documents. Those who have not legally affirmed their gender must still be received as their ‘identified gender,’ but may be treated differently." This policy uses "gender" and "identified gender," terms which are not defined and directly conflict with the Sex Discrimination Act (SDA)’s focus on biological sex. A recent 2025 case involving Terry Mark Donai, a biological male convicted of double murder, exposed this absurdity. Corrective Services NSW (CSNSW) publicly stated: "No transgender inmates are housed in opposite sex correctional centres; no risk of sexual assault convicts entering women’s prison."
